MENYANDINGKAN KONSEP KEBERLAKUAN HUKUM J.J. H. BRUGGINK DENGAN PANDANGAN KEBERLAKUAN HUKUM MENURUT GUSTAV RADBRUCH

Keberlakuan perlu dipahami secara berbeda dengan keterikatan terhadap kekuatannya. Sudikno Mertokusumo menyampaikan pembahasan tentang ‘kekuatan berlakunya Undang-Undang’ memiliki tiga macam kekuatan berlakunya undang-undang, yakni yuridis, sosiologis, dan filosofis.[1]Kekuatan berlakunya suatu hukum positif jika diidentikan dengan hukum dalam mencapai tujuannya, maka sebagaimana yang disampaikan oleh Gustav Radbruchbahwa tujuan hukum itu adalah keadilan, kepastian, dan kemanfaatan. Hukum selalu dalam keadaan bergerak, artinya bahwa proses pemositifan kaidah hukum ke dalam aturan hukum terus menerus terjadi berulang-ulang. Perubahan kerap terjadi dan berlangsung terus menerus, sehingga memunculkan suatu pertanyaan apakah tidak dapat ditentukan lebih jauh, pada kaidah hukum yang mana pada suatu saat tertentu kita harus berpegang, hal ini adalah pertanyaan tentang keberlakuan hukum. Jika ditelaah dari sudut pandang semantik atau ilmu tentang makna kata dan kalimat, maka terbuka kemungkinan berbagai pendapat tentang hukum dalam arti empiris, normatif, dan evaluatif, dan kesemua pengertian tersebut menempati kedudukan sentral. Penjelasan keberlakuan bisa disampaikan sebagai berikut:[2]

  1. Keberlakuan Faktual atau Empiris Kaidah Hukum

Keberlakuan kaidah hukum secara faktual atau efektif dapat dikatakan jika masyarakat untuk siapa kaidah hukum itu berlaku yang dipandang secara umum mematuhi kaidah hukum tersebut. Pengertian luas terhadap keberlakuan faktual terhadap kaidah hukum perlu difahami dari seluruh aspeknya, yakni setiap orang yang berwenang menerapkan kaidah hukum tersebut secara benar yang kemudian menyebabkan para warga masyarakat akan berperilaku sesuai dengan (mengacu pada) kaidah-kaidah hukum itu.

  1. Keberlakuan Normatif atau Formal Kaidah Hukum

Positivitas, tidak hanya efektivitas adalah syarat mutlak (noodzakelijke voorwaarde) untuk keberlakuan normatif suatu tatanan hukum. Kelsen (1967) menjelaskan bahwa hukum yang murni hanya akan mungkin terjadi apabila orang mengabstraksinya dari titik ia berdiri (standpunt, keyakinan) dari struktur formalnya, serta berlandaskan kepada suatu kaidah hukum yang lebih tinggi. Ada suatu kertekaitan kaidah hukum tertentu yang di dalamnya kaidah-kaidah hukum itu saling menunjuk satu dengan lainnya. Tertumpunya suatu kaidah hukum khusus terhadap kaidah-kaidah hukum umum.

  1. Keberlakuan Evaluatif Kaidah Hukum

Suatu kaidah hukum dipandang bernilai jika didasarkan atas substansinya, yang memiliki kekuatan mengikat (verbindende kracht) atau sifat mewajibkan (verplichtend karakter). Setiap orang berkewajiban untuk mematuhi suatu kaidah hukum, yang ia pandang bernilai atau sangat penting untuk perilaku sosialnya. Keberlakuan evaluatif suatu kaidah hukum adalah sifat mewajibkannya, atau kekuatan mengikatnya atau juga obligatorisnya (istilah teknis untuk ‘sifat mewajibkan’).

Ketiga keberlakuan kaidah hukum yang secara ringkas telah disebutkan di atas berdasarkan pandanganJ.J. H. Bruggink sekiranya dapat diragakan sebagaimana gambar di bawah ini:

 Pandangan Bruggink di atas apabila disandingkan dengan kelaziman penyebutan kata ‘keberlakuan’ yang dalam tulisan ini adalah tentang hukum, yang mengambil dari istilah dan pengertian keberlakuan hukum menurut Gustav Radbruch, maka keberlakuan normatif atau formal dalam penyebutan lainnya adalah keberlakuan yuridis (juristische geltung), keberlakuan faktual atau empiris dalam penyebutan lainnya adalah keberlakuan sosiologis (soziologische geltung), dan keberlakuan evaluatif dalam penyebutan lainnya adalah keberlakuan filosofis (filosofische geltung). Filosofische Geltungdiartikan bahwa hukum mempunyai kekuatan apabila hukum tersebut sesuai dengan cita-cita hukum (rechtsidee) sebagai nilai positif yang tertinggi (uberpositiven Werte: Pancasila, masyarakat adil dan makmur). Soziologische Geltungdiartikan bahwa diterima atau berlakunya hukum di dalam masyarakat itu lepas dari kenyataan apakah peraturan hukum itu terbentuk menurut persyaratan formal atau tidak, dalam hal ini lebih melihat kepada kenyataan di dalam masyarakat. Juristische Geltungdiartikan sebagai suatu undang-undang atau peraturan telah memenuhi persyaratan formal.[3]

Ide hukum sebagaimana yang disampaikan oleh Gustav Radbruchdalam kajian “The Concept of Law” pada pembahasan Legal Philosophyterpetakan ke dalam tiga prinsip, dengan penjelasannya sebagai berikut:[4]

It has already been remarked that the idea of law refers not only to justice. It includes, as further elements or ‘sides’, expediency and legal certainty. Occasionally, Radbruch, speaks of ‘three principles’ instead of the more familiar three elements or three sides. This is of considerable importance for determining, by means of balancing, the relation of the three elements of the idea of law to each other.

  1. Justice

Justice often takes the place of the greater idea of law in Radbruch’s basic sentence, a fact that indicates the particular importance that he attaches to it. This high-level systematic ranking is connected, however, with a minimal content. Justice is understood as equality, and as equality it is defined in a purely formal way. The two classical elements of formal justice are found here, albeit not always clearly separated. The first is the general form. Radbruch says in this connection that ‘it is essential to a legal precept … that the claim to generalizability be raised’. ‘Generalizability’ is not thereby understood as referring to some test of universalizability. The claim of legal precepts to generalizability is confined to the claim of having a ‘general character’. This is nothing more than a demand on the logical form of the legal norm, requiring that legal norms have the form: For all x, if x is a T, then it is obligatory that x is a R. Nothing is said here about the content of the norm. The second classical element of formal justice is the Aristotelian demand ‘that equals be treated equally, that unequals be treated differently according to their differences’. Radbruch correctly emphasizes that with this it is not yet said ‘who is to be treated as equal and who as unequal’. But this, so Radbruch in 1932, reaches beyond what justice can say. Justice determines only ‘the form of what is right’. And at exactly this point, Radbruch takes a step that is fraught with consequences for his system: ‘In order to gain the content of law, a second notion must be added, expediency.’ 

  1. b) Expediency

‘Expediency’ is generally understood as speaking to the suitability of a means for the realization of a purpose. Expediency in Radbruch’s philosophy is something altogether different. It refers not to means but to purposes, and not to just any purpose but only to purposes that are ‘capable of absolute value’. Three kinds of such purposes are said to exist: ‘individual human personalities, collective human personalities, and human artefacts’. The question of whether and how, on this basis, the content of justice can be determined shall be considered in the context of the purpose triad, which consists of these three purposes. It will turn out that this triad is the place where the link between Radbruch’s legal philosophy before 1933 and after 1945 is found. Ahead of this, however, it is well to turn to the third element of the idea triad, that of legal certainty.

  1. c) Legal Certainty

The third element of the idea of law, legal certainty, serves to compensate for the weaknesses of the first two elements. These weaknesses are epistemic in character. Here one can speak of the problem of practical knowledge. Practical knowledge concerns knowledge about what is obligatory, forbidden, and permit ted, and what is good and bad. If this could be known in law in all cases ‘with scientific discernibility’, the principle of legal certainty would play a relatively small role. The determinations of positive law would not be real determinations. They would have only a declaratory character. The real field of legal certainty would no longer rest on the field of determination but on that of enforcement. This leads directly to the question of the degree to which expediency can give justice a discernibly recognizable content. This turns on the third triad, the purpose triad.

Beberapa aspek keberlakuan yang telah dijelaskan di atas menjadi suatu wujud kajian epistemologis terhadap dalam keberlakuannya secara sosiologis, filosofis, dan yuridis yang menjadi pedoman pada suatu proses pengembanan hukum teoretis dan pembentukan hukum positif.
